Why People Lose Their Speeding Ticket Case
The biggest reason most people lose their speeding ticket case is because they don’t know the rules. The police officer is not allowed to be an advocate only a witness. Police officers usually and successfully, get the Judge’s attention on other things that you may or may not have done to make you look worse then you really did. This should not be allowed, but unless you know the law, you won’t know how to defend yourself. You not only have to know the law of the citation you received but the rules of evidence to timely object, and stop the police officer from giving improper testimony. I know and use the law to fight speeding tickets.
Technical Issues to Deal With
There are also technical issues such as using a radar or lidar gun. There are foundation grounds that the officer must present before talking about the accuracy of the instrument that was used. They may not have been the person that maintained the machine used, and in that case their testimony is hearsay and should not be allowed. An attorney that specializes in speeding ticket cases would not allow an officer to get away with that.
